■ Purpose

The Ministry of Justice's Legislative Council's Family Law Committee has established a committee on family law regarding the status of child rearing after the divorce of parents.The legal system is currently being reviewed. As part of this, the current system of sole custody after divorce will be changed to a system of joint custody.A proposal to establish laws that would allow people to choose their rights has been proposed and is attracting social attention.DVEtc.The parents who need to be more secure and the parents whose parent-child relationships are cut off after divorceTheir respective claims seem to be in direct conflict with each other.

 International marriage couples have a different problem than the claims and arguments being made in this way.The background to this is the consensual divorce system. And the issue of custody after divorce is being discussed.The fundamental cause of the controversy is also the consensual divorce system itself.The Legal System Subcommittee did not address the issue of the consensual divorce system itself.

 This symposium aimed to raise awareness of the consensual marriage system through the legal difficulties that international marriage families face.This raises the issue of international divorce, which is a typical example of the problems with the consensual divorce system.At the symposium, we will share the issues and make it more accessible to all families in Japan or those connected to Japan.I would like to consider a divorce system that is open to the future.
